Terms of Service

FocusTutor AI is a study assistant that uses artificial intelligence ("AI") to help students review their own school material: it generates explanations, challenges, quizzes, diagrams and supporting images from the content the user uploads.

The Service is a study-support tool. It does NOT replace formal teaching, professional guidance (educational, psychological or medical) or adult supervision.

There are two account types: (a) parent/guardian accounts, which create and manage access for underage students; and (b) adult student accounts, whose holder declares being of legal age at signup.

Minors may only use the Service through access created and supervised by their parent or legal guardian, who accepts these Terms on the minor's behalf and is responsible for the minor's use of the Service and the costs it generates.

Anyone who signs up as a student declaring legal age personally assumes responsibility for their account and usage costs. If that declaration is false, the Operator assumes no liability arising from it.

You are responsible for keeping your credentials confidential and for all activity under your account.

Service content (explanations, answers, challenges, images, diagrams) is generated or selected automatically by third-party AI models. Although we apply reasonable filters and safeguards, AI can produce incorrect, incomplete, biased or, in exceptional cases, inappropriate content.

YOU ACKNOWLEDGE AND AGREE THAT: (a) AI-generated content is provided "AS IS", with no warranty of accuracy, suitability or pedagogical fitness; (b) it must be verified before being used for important decisions (exams, graded work, health, etc.); and (c) the Operator will not be liable for damages arising from errors or omissions in such content, nor for inappropriate content generated despite the safeguards in place.

If you find incorrect or inappropriate content, please report it to the contact email so we can improve the filters.

Using the Service consumes AI resources that have a cost. The parent/guardian (or the self-managed adult student) is responsible for the amounts generated by their account and their students' accounts, according to the limits and rates shown in the billing panel.

The Operator may set monthly spending limits per student and suspend AI-consuming features when they are reached.

Paid subscription plans are processed by PayPro Global, Inc. (Toronto, Canada), acting as merchant of record: it is the legal seller to you and handles charging, receipts, applicable buyer taxes and refunds, in accordance with the Refund Policy published on the Service and with its own purchase terms (payproglobal.com/legal). Plan prices are shown before tax; if the rules of your country require a tax, it is added at checkout.

Subscriptions renew automatically every month, on the same date, until you cancel them. You can cancel, reactivate or change plan from the billing panel of the Service.

Plan changes: when you upgrade, the change is immediate and the difference is not charged for the rest of the current period; from the next renewal the price of the new plan is charged. You can upgrade at no cost once per billing period. When you downgrade, you keep the current plan until the next renewal, and from then on the price of the new plan is charged. To move to a plan with fewer students, you must first archive the profiles above its limit.

Cancellation: when you cancel, you keep the plan until the end of the period you already paid for and no further charges are made; before that date you can reactivate it at no cost. Afterwards, the account moves to the Free plan and keeps its data and student profiles. Refunds are governed by the Refund Policy.

When you buy, PayPro Global creates a customer account in your name with the email you use to pay. From that account you can change the payment method, download receipts and also cancel the subscription.

Evaluation access (pilot): the Operator may grant free access to a paid plan for a set time or with no end date. This access does not create automatic charges; when it ends, the account returns to its paid plan, if it has one, or to the Free plan.

You keep ownership of the material you upload (PDFs, photos, notes). By uploading it, you grant the Operator a limited license to store and process it (including sending it to AI providers) for the sole purpose of providing the Service to you.

You represent that you have the right to use the material you upload (for example, your own school material) and that it does not infringe third-party rights.

The Service relies on external providers, including: Vercel (hosting), Supabase (database and storage), OpenAI (AI processing), Resend (transactional email) and image sources (Wikimedia, Wikipedia, iNaturalist, Pixabay, Unsplash).

The Operator does not control these providers' infrastructure. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE for outages, data loss, unauthorized access, leaks or other security incidents originating in those providers or in circumstances beyond its reasonable control, without prejudice to notifying you of incidents it becomes aware of as described in the Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CONTINUOUS AVAILABILITY OR ACADEMIC RESULTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE OPERATOR NOR ITS AFFILIATES WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, NOR FOR LOSS OF DATA, PROFITS OR REPUTATION, ARISING FROM THE USE OR INABILITY TO USE THE SERVICE, FROM AI-GENERATED CONTENT, OR FROM SECURITY INCIDENTS BEYOND ITS REASONABLE CONTROL.

THE OPERATOR'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE USER FOR THE SERVICE IN THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain liability limitations; in those cases, these limitations apply to the maximum extent permitted.

You agree to indemnify and hold the Operator harmless from third-party claims arising from: (a) your use of the Service in violation of these Terms or the Acceptable Use Policy; (b) the material you upload; or (c) false statements at signup (including legal age).

The Operator may suspend or close accounts that violate these Terms or the Acceptable Use Policy, or when reasonably necessary to protect the Service or its users. You may stop using the Service and request deletion of your data at any time.

We may update these Terms. Relevant changes will be communicated within the Service or by email. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the Republic of Costa Rica. Any dispute arising from these Terms or the use of the Service will be submitted to the competent courts of the Republic of Costa Rica, unless mandatory law applicable to the user provides otherwise.
